Dubai Court Throws Out Dh360 Million Compensation Case, Citing Finality of Special Committee Ruling

Dubai: The Dubai Civil Court has dismissed a high-value compensation claim of Dh360 million filed by a company manager, ruling the case inadmissible on the grounds that it challenges a decision issued by a special judicial committee whose rulings are final and cannot be appealed.

The claimant had argued that he suffered significant financial and reputational damage after being accused of forgery and subjected to enforcement actions, including the attachment of assets and disruption of his business operations. He described these measures as arbitrary and damaging to both his commercial activities and personal standing.

According to court documents, the manager estimated his annual business losses at around Dh60 million, which he said accumulated over time to reach Dh360 million by 2026. He also referenced an additional Dh68 million tied to disputed cheque-related funds, which he included in his overall financial losses.

In his filing, the claimant challenged the authority of the special judicial committee, alleging that it had exceeded its jurisdiction by issuing decisions of a penal nature. He maintained that such powers fall exclusively within the remit of the courts. He also raised procedural concerns, including questions over the legal standing of the defendants and the validity of the legal framework applied.

The claimant requested the court to appoint an expert to assess the damages, suspend all measures taken against him, and facilitate the restoration of his reputation.

However, after reviewing the case, the court concluded that the core of the lawsuit amounted to a direct challenge to the legality and binding nature of the committee’s ruling. It emphasized that, under established legal principles, decisions made by such committees are final and cannot be contested before civil courts.

The court further noted that the compensation claim was effectively an indirect appeal against the committee’s decision, which is not permitted. It added that the request to appoint an expert was secondary to the main claim and therefore could not be considered once the primary case was deemed inadmissible.

As a result, the court dismissed the case in full, ordering the claimant to cover all legal costs and pay Dh5,000 in lawyers’ fees. The ruling reinforces the legal principle that decisions issued by special judicial committees remain binding and beyond the scope of challenge in civil courts.
