Mohammed Bin Rashid Issues New Law to Regulate DIFC Courts’ Jurisdiction and Operations
In his capacity as the Ruler of Dubai, His Highness Sheikh Mohammed bin Rashid Al Maktoum, Vice President and Prime Minister of the UAE, has issued Law No. (2) of 2025, aimed at enhancing the judicial and administrative framework of the Dubai International Financial Centre (DIFC) Courts.
The law establishes a clear jurisdictional structure for DIFC Courts, including the Court of Appeal, the Court of First Instance, and the Small Claims Tribunal, ensuring their independent operation. It also defines the appointment process and responsibilities of the Chief Justice and the Director of the Courts.
A key feature of the new legislation is the introduction of a Mediation Centre, providing an alternative dispute resolution mechanism where parties can resolve disputes amicably with registered mediators. The DIFC president will oversee its jurisdiction and operational framework.
The law grants exclusive jurisdiction to DIFC Courts over civil, commercial, and labor disputes involving DIFC bodies, institutions, and employees. It also covers cases related to trust deeds, non-Muslim wills, and the enforcement of arbitration awards under DIFC arbitration law. Additionally, DIFC Courts can handle provisional and protective measures concerning identity and asset inquiries.
Replacing DIFC Law No. (10) of 2004 and Law No. (12) of 2004, the new law annuls any conflicting provisions while allowing existing regulations to remain in effect until updated. It will be published in the Official Gazette and take effect the following day.
